Terms and Conditions

The following Terms and Conditions apply to all bookings made on this website, in person, via a third party booking site etc. We kindly ask that you take a moment to read them prior to making a Booking.

The Company enters into this Agreement as principal for Bookings made for the hotels it owns and as agent where a Booking is made for a hotel that it operates on behalf of the Hotel Owner. The booking confirmation will clearly state the identity of the Owner.

In these Terms and Conditions the following definitions apply:

 Definitions

“Company” or “we” means PD Resort Sdn Bhd (Company No. 92852-V) and /or JB Parade Sdn Bhd (Company No. 189478-U).

 “Booking” means the booking for accommodation, functions and/or any other services or items made with us.

“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.

“Hotel” means the premises for which your Booking is made.

“Terms” means these terms and conditions.

“Websites” means www.thistle.com.my or any other website owned or operated by us relating to a Hotel from time to time.

“GST” means Goods and Services Tax Act 2014 (GST)

Bookings

Guests may book in advance or on arrival. Rooms are subject to availability and the Company reserves the right to refuse any Booking for good reason. Although payment is generally required on departure, there may be occasions when the Guests are required to fully prepay or provide a deposit at the time of the Booking, or, on arrival at the Hotel.

Charges

The prices displayed on the website or quoted are a total for your requested stay. Any meals, service or GST (at the prevailing rate) are included only if specified. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified. Prices shall be charged in the local currency of the Hotel and any currency conversion facility is provided as an approximation tool only, please refer to the Currency Disclaimer for more details.

The GST breakdown shown is indicative based on the current rate of GST, and the expected GST treatment of the goods or services, and may change depending on the actual tax point of the invoice, and the GST treatment of the goods and services purchased at that date.

Tourism TAX, will be imposed to non-Malaysian nationals and non-permanent residents at the rate of RM10 per room, per night .

Price lists for additional items, such as Restaurant meals, are on display at relevant locations within the Hotel and are available on request.

 

Payment

You will be asked to provide a credit card (or debit card) at the time of the Booking to secure your reservation or at check-in. You must bring a form of payment with you as you will be required to pay for the room on arrival for your entire stay or a deposit at the time of booking in certain circumstances or if the Booking includes the supply of certain items or services. No Booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided.

Once a rate is selected on the Websites, the total for your requested stay shall be displayed on the reservation summary.  The GST breakdown shown is indicative based on the current rate of GST, and the expected GST treatment of the goods or services.  GST will be payable at the prevailing rate applicable at the tax point of the invoice or Booking confirmation issued, and may change depending on the actual rate and the GST treatment of the goods and services purchased at that date.

We accept the following methods of payment: Cash, credit cards: American Express, MasterCard, , Visa; debit cards - Visa and Visa/Electron. The Guest must pay all outstanding charges on departure from the Hotel.

During your stay the Hotel’s system will calculate the incidentals charged to your room on a daily basis.  If the cost of those incidentals exceeds the authorisation taken on check-in, further authorisation will automatically be requested and if such authorisation is not available, we may request another method of settlement or a deposit to be provided, failing which we reserve the right to restrict access to your room.

All outstanding charges must be paid for in full on check-out from the Hotel.  If the outstanding charges do not exceed the authorisation taken on check-in, the authorisation for the amount not utilised will be released, however, we cannot control how long it takes for your bank to effect such release.  If staying for multiple nights at the Hotel we may require you to make payment for any outstanding charges on a more frequent basis during your stay.

Arrival and Departure

Guests may check-in at any time from 3.00 p.m. on the scheduled day of arrival. All rooms that have been secured by credit/debit card or prepaid at the time of booking will be held until 11.59pm on the scheduled day of arrival unless otherwise agreed directly with the Hotel.  Any non-secured reservation will be held until 2.00p.m. on the day of arrival at which time the Hotel is entitled to re-let the room, unless the guest has notified the Hotel of a late arrival.

On the day of departure we kindly ask all guests to vacate their rooms by 12 noon (unless a later departure is stated as part of your booking). Late check-out after this time can be requested subject to availability and will be charged at an hourly rate at the discretion of the hotel

In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference; their passport/identity card/driving licence and a valid credit or debit card which will be swiped in the presence of the card holder. These records will be kept for at least 12 months and may be disclosed or made available for inspection by any police officer or as otherwise required by applicable law in connection with the prevention or investigation of crime.  The information above may be requested for each member of your party over the age of 16 and we reserve the right to refuse entry to persons who cannot provide the information set out above.

Cancellation/ Non-Arrival

The cancellation policy varies according to the rate that is booked.  Please refer to the individual full rate descriptions given at booking.

Any cancellation must be informed to Hotel not less than 48 hours prior to check in time to avoid charges.

Cancellation and non-arrival charges apply after this time and will be charged to the credit / debit card supplied at the time of booking. The Company reserves the right to charge for one night’s accommodation per room booked if the above cancellation requirements are not met, any additional nights will be automatically cancelled.

 

Change of Booking Details or Cancellation by the Company

Reservations may be amended in line with the Booking conditions accepted at the time of the original reservation/s. Changes may be made subject to those conditions and any deposit / prepayment held is subject to those booking terms at the time of the original reservation.

Your booking is for a class of room in the Hotel and does not guarantee that you will be able to stay in a specific room or in the same room for the duration of your stay. If you have indicated a preference for a particular room through a "choose your own room" facility on the Website, we will use our reasonable efforts to honour this preference. However, we may need to allocate an alternative room to you for operational or safety reasons. If we need to move you to a different room during your booking for which a lower rate is available than the rate you booked at, we will refund you the difference in the rates.

Where the Booking permits, any change to the arrival date, departure date or room type is subject to availability at the time the change is requested and may result in a possible rate change.

 

Damages

We reserve the right and you hereby authorise us to charge your credit or debit card for any damage incurred to your room or the Hotel during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave.

Accessibility

Dependent on your individual needs a selection of specifically designed rooms is provided at each of our hotels.

Parking

The Hotel has a good amount of parking but at peak times may become full. We cannot guarantee or reserve parking for any guests. Parking is entirely at customers own risk.

Hotel Events

Please be aware that at certain times the Hotel may host weddings, events and parties, which you may feel would be an intrusion on your stay.  Please contact the Hotel directly in advance of your stay for further information.

Behaviour

_________________________________________________________________________

Residents or non-residents using the facilities or services of the Hotel are responsible for the behaviour of his, her or its guests at the Hotel and in particular for the orderly conduct of guests attending any function or staying in the Hotel or otherwise making use of the services. You must ensure that no noise or nuisance is caused either for the Hotel or its other guests and clients or its neighbours. You must comply with any reasonable request of the Hotel and with any policies of the Hotel as may apply from time to time.

Smoking or Vaping

All areas of the Hotel are non-smoking or non-vaping. Smoking or vaping is only allowed only at designated area.

Guests that do smoke or vape in rooms or non-designated area, will be charged RM300 to deep clean the room, this will be debited form the card given at the time of booking or checking in.

Children

All children (a person under 16 years of age) staying at the Hotel must be accompanied by an adult and must be supervised by an adult at all times.

There are some rooms in the hotel which can accommodate an extra bed or cot for children.However, these are limited and subject to availability. Additional charges may apply. Please make sure you ask when making the reservation.

Babysitting

A babysitting service is available at the Hotel. We recommend that arrangements are made not less than 7 days prior the scheduled day of arrival to avoid disappointment. Please contact the Hotel directly. 

Restriction

_________________________________________________________________________

Food or fruits that admit strong odour or that can cause staining including durian and mangosteens are strictly prohibited. No cooking is allowed. Pets are not permitted.

Guest will be responsible for any damage in the room and amenities, the Hotel reserves to impose additional charges to deep clean the room, this will be debited form the card given at the time of booking or checking in.

We allow pet assisted animals.

Personal Information

Personal information, will be use by Hotel as reference for future stay.

All personal information stored and used by us is done so in accordance with our Privacy Policy and Cookie Policy, which are available on request or on www.thistle.com.my/privacy_policy 

 Force Majeure

The Company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures. 

 

 

Insurance

 

 

The Hotel’s liability where accommodation is booked for Guest belongings is generally limited under the Innkeepers Act 1952.

 

The Company maintains appropriate insurance cover where the Hotel is liable for any injury or loss or damage suffered by our Guests.

 

In the unlikely event that you have a problem during your stay you must bring it to the attention of the hotel management at the time to ensure that we have an opportunity to rectify the problem during your stay.

 

Liability

The Hotel does not accept liability for loss or damage to any object, equipment, furniture, stock or any other property brought onto the premises by the Guest or persons authorised by the Guest. Cloakrooms are provided for the convenience of the Guests but any property deposited there is entirely at your own risk.

 

CCTV

_________________________________________________________________________

 

In the public areas and car park of the Hotel, CCTV is in operation and video recordings may be made. This activity is carried out for security and service reasons.
